RESOLUTION 2003-95

A RESOLUTION GRANTING APPROVAL OF A CLASS C PROPRIETARY LICENSE TO WESTFIELD SHOPPINGTOWN – HAWTHORN LOCATED AT 122 HAWTHORN CENTER.

WHEREAS, Brian Newman, representing Westfield Shoppingtown – Hawthorn, has submitted an application for a Class C proprietary license for authorization to install one, six (6) ride kiddie platform, one photo sticker booth, and one portrait photo booth on level one in the Westfield Shoppingtown – Hawthorn mall located at 122 Hawthorn Center; and

WHEREAS, Section 11-3 (e) of the Village of Vernon Hills Code of Ordinances authorizes the Board of Trustees of the Village of Vernon Hills to grant proprietary licenses to applicants in accordance with the rules and regulations set forth in Section 11-32 of the Code of Ordinances; and

WHEREAS, the applicant appeared before the Board of Trustees at the Committee of the Whole meeting on June 19, 2003 and stated that Westfield would not exceed the number of devices listed in the application which includes, one, six (6) ride kiddie platform, one photo sticker booth, and one portrait photo booth; and

WHEREAS, the Board of Trustees, having reviewed and considered the Westfield Shoppingtown – Hawthorn Class C proprietary license application and plan, found that the application and plan sufficiently comply with the rules and regulations outlined in Section 11-32 of the Code of Ordinances and which, in its judgment, would justify it in granting the Class C proprietary license.

NOW, THEREFORE, BE IT RESOLVED by the Village President and Board of Trustees of the Village of Vernon Hills, Lake County, Illinois, that the Village of Vernon Hills grants Westfield Shoppingtown – Hawthorn a Class C proprietary license, subject to:

1. Compliance with the rules and regulations described in the Village of Vernon Hills Code of Ordinances - Chapter 11, Section 11-32.

2. Limiting the number of devices as stated in the application and plans on file in the Community Development Department dated June 6, 2003.
