RESOLUTION 2003-187

A RESOLUTION THAT AUTHORIZES THE FINANCE DIRECTOR TO DISTRIBUTE DEVELOPER COLLECTED FUNDS TO THE VILLAGE OF VERNON HILLS, COUNTRYSIDE FIRE DISTRICT, HAWTHORN CONSOLIDATED COMMUNITY SCHOOL DISTRICT #73, AND COMMUNITY HIGH SCHOOL DISTRICT #128 AS PROVIDED IN THE DEVELOPMENT PERMIT AND AGREEMENT FOR THE AMLI AT MUSEUM GARDENS RESIDENTIAL DEVELOPMENT LOCATED IN POD I OF THE GREGG’S LANDING SUBDIVISION.

WHEREAS, the Village President and Board of Trustees of the Village of Vernon Hills is authorized to prescribe rules and regulations for the use of public and private property for the purpose of promoting the public health, safety, comfort, convenience, and general welfare of the people of Vernon Hills; and

WHEREAS, as the population of the area increases, the need to improve infrastructure, recreational, educational, and public safety facilities and services also increases; and

WHEREAS, the Village President and Board of Trustees have adopted ordinances and negotiated development permits and agreements that require the developer to pay, donate, and/or dedicate land for improving said infrastructure, recreational, educational, and public safety facilitates and services within the Village; and

WHEREAS, the Village President and Board of Trustees passed Ordinances 2003-08 and 2003-16 that executed a development permit and agreement development agreement with Amli Residential, Inc. the developer of the Museum Gardens residential development located in POD I of the Gregg’s Landing Subdivision and that required Amli Residential, Inc. to donate one hundred fifty thousand (150,000) dollars for public infrastructure and safety improvements and four hundred eighty five thousand twenty eight (485,028) dollars for educational purposes; and

WHEREAS, Amli Residential, Inc. the developer of the Amli at Museum Gardens residential development located in POD I of the Gregg’s Landing Subdivision has paid, to the Community Development Department, the fees required by the development permit and agreement passed by Ordinances 2003-08 and 2003-16 in conjunction with the required building permit fees.

NOW, THEREFORE, BE IT RESOLVED by the Village President and Board of Trustees of the Village of Vernon Hills, Lake County, Illinois:

THAT, the Village of Vernon Hills Finance Director is authorized to recognize $90,000 of the funds as revenue to the Village of Vernon Hills for designated improvements and to make the following payments:
