A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND CLERK TO SIGN PRIVATE ACCESS DRIVE IMPROVEMENT AGREEMENT TRANSFERING OWNERSHIP OF CERTAIN PORTIONS OF LOTS TO THE VILLAGE OF VERNON HILLS (a.k.a. Babies R Us Private Road)
WHEREAS, there exists a private access drive, also referred to as the “Babies R Us Private Road” (hereinafter referred to as “the Private Road”) generally located west and south of the intersection of Center Drive and Ring Drive, said Private Road and related properties are identified in Exhibit A; and,
WHEREAS, this Private Road is owned by multiple property owners and serves as an access point from Center Drive to several businesses including Babies R Us, Whirlyball and the Hawthorn Village Commons shopping center; and,
WHEREAS, due to the lack of maintenance of this Private Road and the amount of traffic it carries from Center Drive and Hawthorn Village Commons shopping center, the Village of Vernon Hills desires that the Private Road be dedicated and transferred to the Village in consideration for the Village assuming the maintenance and repair responsibilities of the Private Road; and,
WHEREAS, the owners of this Private Road have agreed to enter into a Private Access Drive Improvement Agreement, said agreement being attached in Exhibit B, to provide for the maintenance and repair of the Private Road and to contribute funds towards the future repair of said Private Road; and,
WHEREAS, the President and Board of Trustees are now prepared to accept said Private Road and associated property.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF VERNON HILLS, COUNTY OF LAKE AND STATE OF ILLINOIS,
Section 1: That the Village President and Village Clerk be and the same are hereby authorized to execute the Private Access Drive Improvement Agreement, said agreement being attached in Exhibit B thereby dedicating the Private Road and relate maintenance and repair responsibilities to the Village of Vernon Hills.
