RESOLUTION 2003- 125
A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH
THE VILLAGE OF LIBERTYVILLE AND THE CUNEO TRUST
FOR INSTALLATION AND MAINTENANCE
OF LANDSCAPED MEDIAN ON MILWAUKEE AVENUE/IL21
WHEREAS, Article VII, Section 10 of the 1970 Constitution of the State of Illinois authorizes units of local government to contract or otherwise associate among themselves and private property owners with respect to the construction and maintenance of public improvements; and
WHEREAS, the Village of Vernon Hills and the Village of Libertyville, both municipal corporations (hereinafter “Vernon Hills” and “Libertyville”) and the Cuneo Trust (hereafter “Cuneo”) desire to enter into an Intergovernmental Agreement for the purpose of constructing and providing the necessary funding for a landscaped median on a portion of Milwaukee Avenue/IL21, located between Hawthorn Mall Drive in Vernon Hills and Red Top Drive in Libertyville; and
WHEREAS, the President and Board of Trustees of the Village of Vernon Hills have found and determined that in the spirit of intergovernmental cooperation, it is appropriate to enter into the Intergovernmental Agreement with the Village of Libertyville and the Cuneo Trust.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF VERNON HILLS, COUNTY OF LAKE, ILLINOIS AS FOLLOWS:
Section One: Recitals. The foregoing recitals are incorporated as if fully set forth.
Section Two: Approval of the Agreement. The Agreement by and between the Village of Vernon Hills, the Village of Libertyville, and the Cuneo Trust shall be, and same hereby is, approved in a form substantially the same as is attached hereto and by this reference incorporated herein and made a part hereof as Exhibit A.
Section Three: Execution and Attestation of Agreement: The Village President and Village Clerk shall be, and they hereby are, authorized and directed to execute and attest, respectively, the Agreement on behalf of the Village of Vernon Hills.
Section Four: Effective Date. This resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
