ORDINANCE NUMBER 2003-72

 

AN ORDINANCE AMENDING THE OVERALL LANDSCAPE PLAN AND FINAL PLANNED UNIT DEVELOPMENT (PUD) SPECIAL USE PERMIT FOR COUNTRY COMMONS (GEORGETOWN SQUARE) FOR THE PURPOSE OF INSTALLING PLAYGROUND EQUIPMENT.

 

WHEREAS, on January 16, 1996, upon due notice and public hearing, the President and the Board of Trustees of the Village of Vernon Hills approved Ordinance 96-15 that granted a Final Planned Unit Development Special Use Permit for Country Commons, currently known as Georgetown Square a single-family residential condominium community; and 

 

WHEREAS, the Georgetown Square Condominium Association has requested an amendment to the originally approved Overall Landscape Plan, dated November 1, 1995, and Final PUD Special Use Permit, dated January 16, 1996, for the purpose of installing playground equipment; and

 

WHEREAS, the President and Board of Trustees prescribe minimum standards for the use of privately-owned property for the purpose of promoting the public health, safety, comfort, convenience, and general welfare of the people of Vernon Hills found that in its judgment, would justify it in approving an ordinance amending the originally approved Overall Landscape Plan and Final PUD Special Use Permit so playground equipment can be used and enjoyed by residents who reside in the community;

 

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF VERNON HILLS, LAKE COUNTY, ILLINOIS AS FOLLOWS:

 

SECTION I.  Pursuant to the Village of Vernon Hills Zoning Ordinance of 1982, as amended, an amendment to the Overall Landscape Plan dated November 1, 1995 and Final PUD Special Use Permit dated January 16, 1996 is hereby approved for the purpose of installing playground equipment in the common area as provided on the plans attached hereto and labeled as Exhibit "A".

 

PROVIDED HOWEVER, that this amendment to the Overall Landscape Plan and Final Special Use Permit is conditioned upon the Georgetown Square Condominium Association agreeing to connect the playground drain tile directly into the adjacent storm sewer within sixty (60) days upon notification if deemed necessary by the Village Engineer and/or Building Commissioner as confirmed in the attached letter dated August 24, 2003 and labeled as Exhibit "B".    

 

SECTION II. Severability.  In the event that any section, clause, provision, or part of this ordinance shall be found and determined to be invalid by a court of competent jurisdiction, all valid parts that are severable full force and effect.  If any part of this ordinance is found to be invalid in any one or more of its several applications, all valid applications that are severable from the invalid applications shall remain in effect.

 

SECTION III. Repeal and Savings Clause.  All ordinances or parts of ordinances in conflict herewith are hereby repealed; provided, however, that nothing herein contained shall affect any rights, actions, or causes of action which shall have accrued to the Village of Vernon Hills prior to the effective date of this ordinance.

 

SECTION IV.  Effective Date.  This ordinance shall be in full force and effect from and after its passage, approval, and publication as provided by law.

 

SECTION V.  This ordinance shall be known as Ordinance 2003-72.
