ORDINANCE NUMBER 2003-53

 

AN ORDINANCE AMENDING ORDINANCE NOS. 2002-74, 2002-58, 2001-37, 97-33, 96-63, 90-63, 90-24 DESIGNATING STOPPING, STANDING, AND PARKING.

 

Whereas, Chapter 625, Act 5, Article XIII, Sections 5/11-1303 (a) (2) (f); (3) (b) (d) of the Illinois Compiled Statutes provide that the Village with respect to streets and highways under its jurisdiction, may place signs prohibiting, limiting or restricting the stopping, standing, parking of vehicles on any street and highway where in its opinion such stopping, standing, or parking is dangerous to those using the street or highway or where the stopping, standing, or parking of vehicles would unduly interfere with the free movement of traffic thereon.

 

Whereas, no person shall stop, stand, or park any vehicle in violation of the restrictions indicated by such devices.

 

Whereas, the Corporate Authorities of this Village have determined that it is in the best interest of the residents of the Village and for the public health, safety, and welfare thereof to restrict stopping, standing or parking any vehicle on streets or highways in the Village.

 

NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT OF TRUSTEES OF THE VILLAGE OF VERNON HILLS, LAKE COUNTY, ILLINOIS, AS FOLLOWS:

 

SECTION I. DESIGNATION OF STREETS.  Parking or standing shall be prohibited on the streets and highway within the Village of Vernon Hills as shown on Exhibit “A” attached hereto and incorporated herein and entitled “STREET AND HIGHWAY RESTRICTIONS” which shall delineate the prohibited parking areas.

 

SECTION II.  POSTING SIGNS.  Appropriate signs shall be posted upon all roads, highways, or streets under the jurisdiction of the Village as specified in this Ordinance.

 

SECTION III.  PENALTY.  Any person who shall violate any of the provision of this ordinance shall be guilty of an offense hereunder and upon conviction thereof shall be punished by fine of not less than $5.00 nor more that $500.00 for each such violation.

 

SECTION IV. SEVERABILITY.  In the event that any section, clause, provision, or part of this ordinance shall be found and determined to be invalid by a court of competent jurisdiction, all valid parts that are severable from the invalid parts shall remain in full force and effect.  If any part of this ordinance is found to be invalid in any one or more it’s several applications, all application that are severable from the invalid applications shall remain in effect.

 

SECTION V. All ordinances or parts of ordinances in conflict herewith are hereby repealed; provided, however, that noting herein contained shall affect any rights, actions, or causes of action which shall have accrued to the Village of Vernon Hills prior to the effective date of this ordinance.

 

SECTION VI.  EFFECTIVE DATE.  This ordinance shall be in full force and effect from and after its passage, approval, and publication as provided by law.

 

SECTION VII.  PUBLICATION.  This ordinance shall be published in pamphlet form in the manner provided by law.

 

SECTION VIII.  ORDINANCE NUMBER.  This ordinance shall be known as Ordinance Number 2003-53.
