ORDINANCE NO. 2003 - 51

 

AN ORDINANCE AUTHORIZING THE VILLAGE OF VERNON HILLS TO APPROVE A CERTAIN TEMPORARY CONSTRUCTION EASEMENT, PARCEL 017TE.

 

WHEREAS, the Village of Vernon Hills has determined that it is in the public interest to improve the intersection of Fairway Drive/Prairie Road and U.S. Route 45 and has approved this project through Resolution 2000-26; and

 

WHEREAS, the Village of Vernon Hills has determined that it is in the public interest to grant to the State of Illinois a certain temporary easement as described in Exhibit A for public road and transportation purposes,

 

WHEREAS, there exists a parcel of real property located generally alongside U.S. Route 45, in the Village of Vernon Hills, Illinois, whose common address is:  West of and adjacent to Lots 13 and 15 according to the  Plat of River Grove Subdivision in Vernon Hills;

 

WHEREAS, the Property is located entirely within the corporate limits of the municipality.

 

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF VERNON HILLS, COUNTY OF LAKE AND STATE OF ILLINOIS:

 

 

SECTION I.  Preambles Incorporated.  The above preambles are hereby incorporated by reference.

 

SECTION II.        Temporary Construction Easement Agreement. The Board approves the AGREEMENT CONCERINING LAND FOR A TEMPORARY EASEMENT and authorizes the Village President to sign the TEMPORARY EASEMENT, CORPORATE RESOLUTION, and THE CORPORATE AFFIDAVIT.

 

SECTION III.  Repeal and Savings Clause.  All ordinances or parts of ordinances in conflict herewith are hereby repealed; provided, however, that nothing herein contained shall affect any rights, actions or causes of action which shall have accrued to the Village of Vernon Hills prior to the effective date of this ordinance.

 

 

SECTION IV.  Effective Date. This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.

 

 

SECTION V. Ordinance Number. This ordinance shall be known as Ordinance Number 2003-51.
