ORDINANCE NO. 2003-44

 

 

AN ORDINANCE AMENDING ORDINANCES 2002-41 AND 2001 – 61 GRANTING FINAL SITE AND LANDSCAPING PLAN APPROVALS TO ZALE HOMES FOR THE REVISED Custom Home Sales Center LOCATED north side of Gregg’s Parkway, just east POD D (Bay Hill) in Gregg’s Landing, IN THE VILLAGE OF VERNON HILLS, LAKE COUNTY.

 

 

WHEREAS, Zale Homes, in regard to properties legally described in Exhibit A, has petitioned the Village of Vernon Hills, pursuant to The Hawthorn Properties Annexation Agreement dated November 15, 1988 and amended from time to time, to amend the approved the final site, landscaping and architectural plans for the Custom Home Sales Center located on the north side of Gregg’s Parkway, just east of Pod D (Bay Hill) in Gregg’s Landing; and,

 

WHEREAS, said Custom Home Sales Center was originally approved as Ordinance 2001-61 and subsequently amended as Ordinance 2002-41; and,

 

WHEREAS, Zale Homes has requested to amend Ordinance 2002-41 to allow for a 60'x28' sales trailer with attached front and rear porches covered by a shingled, sloped roof as depicted in Exhibit B.

 

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF VERNON HILLS, COUNTY OF LAKE AND STATE OF ILLINOIS:

 

SECTION I.  Pursuant to The Hawthorn Properties Annexation Agreement dated November 15, 1988 and amended from time to time, the amended final site, landscaping and architectural plans for the Custom Home Sales Center located in Gregg’s Landing, is hereby approved as presented.  Said approval is subject to the plans attached in Exhibit B and to the following conditions:

 

  1. The Sales Center shall remain for a maximum of three years after the issuance of a temporary of final Certificate of Occupancy.  The petitioner may apply to the Village Board for an extension of time prior to expiration of this approval.
  2. If development of the commercial lot occurs while the trailer is in use, it shall be permitted to remain on the site subject to approval by the Village Board.
  3. The site shall be developed pursuant to the plans submitted by Bloodgood, Sharp, & Buster Architects, Inc. consisting of 3 pages and a received date of 5/30/03.
  4. Final approval by the Village’s Engineer and Landscape Architect prior to issuance of a building permit.
  5. Compliance with all ordinances and standards of the Village except as otherwise provided for in the Gregg’s Landing Development and Land Management Agreements.

 

SECTION II.            SEVERABILITY. In the event that any section, clause, provision, or part of this ordinance shall be found and determined to be invalid by a court of competent jurisdiction, all valid parts that are severable from the invalid parts shall remain in full force and effect.  If any part of this ordinance is found to be invalid in any one or more of its several applications, all valid applications that are severable from the invalid applications shall remain in effect.

 

SECTION III. REPEAL AND SAVINGS CLAUSE. All ordinances or parts of ordinances in conflict herewith are hereby repealed; provided, however, that nothing herein contained shall affect any rights, actions or causes of action which shall have accrued to the Village of Vernon Hills prior to the effective date of this ordinance.

 

SECTION IV. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.

 

SECTION V. ORDINANCE NUMBER. This ordinance shall be known as Ordinance Number 2003-44.
