COMMITTEE OF THE WHOLE MEETING

VILLAGE OF VERNON HILLS

OCTOBER 21, 2003    

 

 

 

IN ATTENDANCE: President Byrne called the meeting to order at 7:55 p.m. The following Trustees were present: Duros, Hebda, Koch, Cashman, Williams, and Weil.

 

Also present were Manager Allison, Assistant Manager Kalmar, Assistant to the Manager Teich, Public Works Director Laudenslager, Finance Director Nakrin, Building Commissioner Gerth, Village Engineer Brown, Attorney Citron, and Village Clerk Schwartz.

 

 

1. PRESENTATION OF CONCEPTUAL SITE PLAN BY COLLEGE OF LAKE COUNTY FOR PROPERTIES LOCATED NORTH OF THE INTERSECTION OF ROUTE 45 AND MILWAUKEE AVENUE AND WITHIN THE TIF REDEVELOPMENT AREA

The conceptual site plan for CLC was presented. The College will provide an easement to let Port Clinton Road connect and the retention pond will be oversized to accommodate stormwater. They will also provide a level of cooperation to connect the other road. The College sent out letters to local residents of Georgetown inviting them to view the project, which they reviewed favorably. Trustee Hebda asked the College to work closely with Georgetown in designing the landscape plan. Trustee Koch suggested using nondeciduous trees as a buffer to Georgetown. The Committee was pleased with the plan and there was consensus to move forward to technical review.

 

 

2. WESTFIELD SHOPPINGTOWN – HAWTHORN – CONSIDERATION OF REQUEST FOR A SPECIAL USE PERMIT TO ALLOW A FUN TIMEOUT DROP-OFF CHILDCARE CENTER

Assistant Manager Kalmar stated the petitioner, Shannon Witt, would like to request approval of a special use permit to allow for the operation of an hourly “drop-off” childcare center in Westfield Shoppingtown. The Planning & Zoning Commission voted 5-1 to recommend approval subject to conditions. The special use permit would expire if a new operator took over the facility. Attorney Citron stated there would be no liability for the Village. The special use can also be eliminated if violations are found. Trustee Duros preferred the business to be monitored by DCFS. Ms. Witt stated that if parents are on the premises, DCFS does not need to be involved. It would also be more costly for the parents. Churches and health club daycares are not monitored by DCFS. Motion by Trustee Cashman, second by Trustee Koch to draft the necessary ordinance approving the Special Use Permit to allow a Fun Timeout Drop-Off Childcare Center at Westfield Shoppingtown and amending Article 13, Section 13.3 Special Uses, of the Village of Vernon Hills Zoning Ordinance adding a “Drop-off Childcare Center” to the list of special uses, subject to conditions as outlined by Planning & Zoning and village ordinances. Roll call vote:

AYES: 4 – Cashman, Koch, Williams, Byrne

NAYS: 3 – Duros, Hebda, Weil

CONSIDERATION OF PROPOSED ORDINANCE TO AMEND ARTICLE 13, SECTION 13.3 SPECIAL USES, OF THE VILLAGE OF VERNON HILLS ZONING ORDINANCE ADDING A “DROP-OFF CHILDCARE CENTER” TO THE LIST OF SPECIAL USES.

3.  TSUKASA OF TOKYO – PRESENTATION OF CONCEPT PLAN FOR RESTAURANT TO BE LOCATED ON THE EXPO OUTLOT IN THE MARKETPLACE OF VERNON HILLS SHOPPING CENTER – MILWAUKEE AVENUE

Assistant Manager Kalmar reported that Tsukasa would like to present concept plans for a new restaurant to be located in front of EXPO Design Center and Home Depot. This would be a relocation of the present facility in Hawthorn Hills Fashion Square. John Hersey, of JMH Architects of Mundelein, stated the petitioner needs additional space but would like to stay in the Village. The concept plan was presented showing the new building on 1.27 acres between Circuit City and Home Expo. The parking was considered adequate. Trustee Koch recommended switching the bathrooms so there would be more stalls for the women and less for the men. Trustee Hebda requested a blending of outside elements. The Committee gave consensus to move to technical review.  

 

 

4. GREGG’S LANDING, POD A - ACCEPTANCE

Village Engineer Brown stated that staff recommended putting this item on the next consent agenda. The Committee agreed.

6. SARAH’S GLEN – ACCEPTANCE OF SUBDIVISION

Village Engineer Brown stated that staff recommended putting this item on the next consent agenda. The Committee agreed.

 

7. SANCTUARY POINT, HOA FENCE PROPOSAL

Village Engineer Brown reported that Sanctuary Point has requested to install a 6’ board on board fence just inside the property line to add screening from the highway. The fence would be three lots long. Trustee Cashman requested growing vegetation along the fence to block the view from the road. Motion by Trustee Weil, second by Trustee Duros to approve the fence for Sanctuary Point as presented. Roll call vote:

AYES: 6 – Duros, Hebda, Koch, Weil, Williams, Cashman

NAYS: 0 – None

8. CONSIDERATION OF PROPOSED ORDINANCE TO AMEND ARTICLE 4, SECTION 4.7.1, 4.7.1.7, AND 4.7.1.8 GENERAL REGULATIONS, OF THE VILLAGE OF VERNON HILLS ZONING ORDINANCE RELATING TO THE TYPE AND USE OF RECREATIONAL EQUIPMENT ON RESIDENTIALLY ZONED PROPERTY

Motion by Trustee Cashman, second by Trustee Duros to approve the proposed ordinance to amend Article 4, Sections 4.7.1.7 and 4.7.1.8 general regulations, of the Village of Vernon Hills Zoning Ordinance, relating to the type and use of recreation equipment on residentially zoned property. Roll call vote:

AYES: 6 – Hebda, Koch, Weil, Williams, Cashman, Duros

NAYS: 0 – None

9. CONSIDERATION OF PROPOSED ORDINANCE TO AMEND ARTICLE 19, SECTIONS 19.5.1 AND 19.5.2 RESIDENTIAL DRIVEWAYS, OF THE VILLAGE OF VERNON HILLS ZONING ORDINANCE, TO ALLOW FOR DECORATIVE RIBBONS ADJACENT TO RESIDENTIAL DRIVEWAY ENTRANCES (APRON)

Motion by Trustee Duros, second by Trustee Williams to approve the proposed ordinance to amend Article 19, Sections 19.5.1 and 19.5.2 residential driveways, of the Village of Vernon Hills Zoning Ordinance, to allow for decorative ribbons adjacent to residential driveway entrances. Roll call vote:

AYES: 6 – Koch, Weil, Williams, Cashman, Duros, Hebda

NAYS: 0 – None

10. CONSIDERATION OF PROPOSED ORDINANCE TO AMEND ARTICLE 3, SECTION 3.2 DEFINITIONS, OF THE VILLAGE OF VERNON HILLS ZONING ORDINANCE, REVISING THE DEFINITION OF “FLOOR AREA”.

Motion by Trustee Williams, second by Trustee Cashman to approve the proposed ordinance to amend Article 3, Sections 3.2 definitions, of the Village of Vernon Hills Zoning Ordinance, revising the definition of “floor area”. Roll call vote:

AYES: 6 – Weil, Williams, Cashman, Duros, Hebda, Koch

NAYS: 0 – None
